Please read the terms and conditions of this Agreement carefully before placing your order with QA Business.  This Agreement contains important information about the ordering, processing, fulfilment and delivery of goods, including limitations of liability.  In addition to this Agreement, the relevant End User Licence Agreement (“EULA”) governs your use of the products bought from Reckon.  If there is any inconsistency between the terms of this Agreement and the EULA terms of the EULA terms will prevail to the extent of that inconsistency.

By using or accessing this site you acknowledge that you have read, understood and agree to be bound by this Agreement.  You (the purchaser) acknowledge that these terms and conditions embody the whole agreement between the parties and agree to be bound by them.  If you do not agree with the terms of this Agreement please do not make a purchase from the Website.

This Agreement may be amended at any time without notice and your access to this website may be terminated at any time without notice.  Your continued use of the website following such amendment of this Agreement will represent an agreement by you to be bound by this Agreement as amended. You may view the current terms of this Agreement on the website. QA Business recommends that you review the terms for amendments each time you use the website and before placing any order.

 

Legal Capacity - You must be eighteen (18) years of age or over to purchase products from the website.  QA Business reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an order to be placed, for any loss or damage QA Business may suffer as a result of a transaction entered into by a minor.

 

Territory Limit - We only accept orders from and deliver within Australia.

 

Price & Product Information - QA Business may change the prices published on the Website at any time. While every effort has been made to ensure the accuracy of prices and information displayed on the Website, QA Business reserves the right to accept or reject your offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on this site, or an error in your order. We may require additional verification or information before accepting any order.

 

Payment for Goods and Services - For each online order, you must pay the applicable price for the goods as confirmed by QA Business and the delivery fees  as specified on the website at the time. Payment must be cleared before the goods are dispatched.  You agree that, should you not meet these payment terms, QA Business reserves the right to exercise all the rights available to it. QA Business also reserves the right to take legal recovery action, should it deem this necessary and to charge to you and recover from you, costs of doing the same. Such costs include any collection agent fees and legal fees on a solicitor/own client basis. All accounts are cash only. Payment is by credit card only. i.e., Visa or MasterCard. All prices are subject to change without notification.

 

Title to Property - Title to the goods purchased on this website does not pass to you until QA Business has received payment in full for the goods and all relevant payments have cleared. All risk in the goods passes to you upon delivery. The risk of loss or damage to the goods shall be entirely at your own risk upon delivery to you. QA Business reserves the right to retake physical possession of the goods in full until such time as the debt has been satisfied. You agree that QA Business reserves the right to enter upon your premises or the premises of any other associated person where the products are located in order to do this. Monies owed by you to QA Business shall become due immediately upon the commencement of any act or proceedings for your winding up or placement into any form of insolvency administration, whether formal or otherwise.  You acknowledge and agree that these terms and conditions constitute a security agreement in relation to QA Business'security interest in all the present and after-acquired Products in accordance with the Personal Property Securities Act 2009 (Cth) (“the PPSA”). You also acknowledge and agree QA Business'claim and interest in the goods and that the PPSA applies to Reckon’s security interest hereunder.

 

Delivery - Goods shall be delivered within Australia and to the address specified upon placement of the order as the address for delivery. Freight will be charged at a standard rate and sent by Australia Post or shipped by our own courier, at QA Business' sole discretion. A standard freight charge applies to every order regardless of its size or geographical destination within Australia. Freight must be paid on all goods shipped. QA Business will deliver as soon as reasonably possible, taking account of the product and the delivery address, but does not make any warranty in this regard and accepts no responsibility whatsoever for any loss you might suffer by reason of any delay in delivery.

 

Use of Products Purchased - You agree to only use the products purchased in accordance with this Agreement and the relevant End User Licence for the products. 

 

Return Policy - Our goods come with guarantees that cannot be excluded under schedule 2 to the Competition and Consumer Act 2010 (Cth) ("Australian Consumer Law").  You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.  Except as required by the Australian Consumer Law, QA Business will only permit a return of goods and replacement or grant a credit where there was an incorrect shipment of goods or where products are proved by you to be defective at the time of sale and not due to wear and tear, negligence, neglect or default on your part. Goods must be in acceptable (as new) condition upon return, and the seals on all disks and CD's intact. All goods returned must be in 'complete' condition.

 

Procedure for Returning Goods - If you are entitled to make a claim or to return the goods (collectively “Claim”) pursuant to this clause or to the extent required by the Australian Consumer Law, you must:

  1. email info@qabusiness.com.au with the subject line 'product return', and include the following:
    • in the body of the email, provide the IKC, detail the fault and whether a workaround has been provided by a member of Reckon's support team; and
    • provide a copy of the receipt or proof of purchase and payment.

Once QA Business receives the information, QA Business will provide a preliminary assessment of the claim and contact you to advise.

 

Privacy & Personal Information Reckon’s privacy policy is available on this website and explains how your personal information is collected and managed in accordance with the National Privacy Principles in the Privacy Act 1988 (Cth).  You agree to allow Reckon to use and disclose any personal details provided to Reckon in connection with your use of this website and purchase of the goods in accordance with Reckon’s privacy policy.

 

Disclaimer - Certain laws, including the Australian Consumer Law, may imply certain guarantees, conditions and warranties into this Agreement or impose certain guarantees, conditions and warranties by law and give you certain rights and remedies that cannot be excluded or modified.  This Agreement does not exclude or modify any of those rights if to do so would contravene the Australian Consumer Law or any other relevant law or make any part of this Agreement void.  Except as required by the Australian Consumer Law: QA Business will not be liable to you for any loss or damage of any nature (including direct or indirect or consequential loss) resulting from or arising as a consequence of your purchase and use of goods or services. If a term is implied by law as part of this agreement and that term prohibits provisions in a contract excluding or modifying QA Business' liability under that term, then it will be included in this agreement. However, except as required by the Australian Consumer Law, the liability of QA Business for any breach of such term will, if permitted by that law, be limited at the option of QA Business, to one or more of the following: (a) in relation to goods: (i) the replacement of the goods or the supply of equivalent goods; (ii) the repair of such goods; (iii) the payment cost of replacing the goods or acquiring equivalent goods; or (iv) the payment of the cost of having the goods repaired; (b) in relation to services: (i) the supply of the services again; or (ii) the payment of the cost of having the services supplied again.  To the best of the knowledge and information of QA Business and its representatives, all facts, information and figures contained on this Website are true and accurate. QA Business reserves the right to make any changes in information, products available for sale, product details, pricing, offers, promotions and product inclusions, as it may deem necessary, without prior notice.
